¡¡Retailing
£±£® Operator should guarantee that commodities and services by him and corresponding facilities and place accord with requirements for safety of personnel and property.
Operator should give true instruction and clear warning to customer of commodities and services which may endanger safety of personnel and property, clearly explain and mark ways to rightly use commodities or to receive service properly and ways to prevent harms from happening; warning marks should be set up for facilities and place with harmful factors.
£²£® Operator should show his true name and mark and hang his business license in noticeable position of business place.
Person to hold a commodity trading market, supplier of place and counter should announce telephone number, address of consumer supervision and complaint authority, supervise operators, attendants and users of place, counter in the commodity trading market and sales exhibition to show his true name and mark in noticeable position of business place
£³£® Operator can not provide commodities or services in fraudulent means such as taking fake goods as true goods, taking bad goods as qualified goods, adulterations, etc. to infringe on consumers¡¯ rights and interests.
£´£® Operator should provide commodities and services at marked prices without charging any expenses not clearly marked. Operator who provides service should mark service items, content and charge standard(tariff schedule) in noticeable position of business place or casher.
£µ£®Operator should use state-stipulated measuring appliances and legal measurement unit for commodities which needs to be measured.
Operator must not count weight of packing material into weight of commodities, must not give short service in quantity, must not refuse consumer¡¯s requirement for recounting.
£¶£® Operator must not force consumer to purchase commodities or to receive services, must not carry out bundling, provide service or attach other condition against consumer¡¯s will.
£·£® Operator should provide minority people with commodities or services with respect for their social custom. Name and instruction for commodities which are produced and sold in area of the Autonomous Region should be written in minority language and Chinese.
¡¡TeleCommunication
£±£® If there is quality defect in commodities which should be repaired, replaced and returned according to stipulations of the state and the Autonomous Region or to appointments between operator and consumer, the operator should be responsible for repair, replacement and return of the defect commodities under relative stipulation of the state and the Autonomous Region or appointments with the consumer.
Liability period for repair, replacement and return should be carried out according to relative
stipulation of the state and the Autonomous Region or appointments with the consumer. For those
who has no stipulation and no appointment, the liability period for repair, replacement and return
undertaken by operator is 6 months.
£²£®For commodities under policy of repair, replacement and return, if quality defect is found and one of the following situations occurs, the consumer can demand replacement or return:
£¨1£© no guarantee point£»
£¨2£© performance failure occurs in 15 days from date of sales of the commodity
£¨3£© the commodity can serve normally though it has been repaired twice;
£¨4£© the commodity is not repaired in one month from the date for the commodity to be sent for repair.
£³£®If it is the operator¡¯s responsibility to undertake return, he should refund fare for the commodity depending on purchase receipt for one time, and he must not charge depreciation expense.
£´£®If it is the operator¡¯s responsibility to undertake return, he should replace the failure commodity with commodity of the same model and specifications to the consumer. If there is no commodity of the same model and specifications available, the operator should allow return of failure commodity according to requirement of the consumer without depreciation expense charged.
£µ£®If it is the operator¡¯s responsibility to undertake repair, the operator must not charge repair expense and other expenses.
£¶£®Operator in business of repair, process should carry out repair and process according to parts, materials, period, expenses and quality appointed by the operator and the consumer and needed for repair and process . Operator should undertake liability of breach of contract if he breaches appointment to stealthily replace parts which is not needed to be replaced, does shoddy work and uses inferior material, or reports lie of labor and material. If loss happens from the above behaviors, the operator should undertake civil liability.
£·£® Quality of any commodity or service which is provided to customer by operator in name of reward, free gift, discount etc. should be guaranteed, civil liability such as repair, replacement and return which the operator should undertaken and other civil liability should not be exempted .
¡¡Tourism
£±£®Operator of tourism should sign written contract with tourist to specify tour routine, scheduling, lodging and boarding standard, means of transportation, price and liability of breach of contract etc. If shopping is arranged, shopping place, times, time should be specified in the contract. The operator must not force tourist to go shopping.
£²£®If operator, without notice, changes contract appointment, adds items of tour spot, recreation, medical care, shopping etc. or improves standard of lodging and boarding as well as means of transportation, all added expenses and liability of breach of contract from above behaviors will go to the operator; If the operator, without notice, reduces the above-mentioned items or decreases standard, corresponding expenses should be refunded and liability of breach of contract will be covered by the operator.
£³£®If no written tour contract is signed but contractual tour relation in fact is formed, all matters will be dealt with according to the above article 1, 2.
£´£®Operator of food, food & beverage should execute national hygiene quality standard, and provide service under marked content, specifications, price or that agreed with consumer. If food offered does not accord with healthy requirement, the operator should give replacement or refund; If the food infringes consumer¡¯s health, the operator should undertake legal civil liability.
¡¡Real estate
£±£®Operator of real estate should strictly execute laws, rules related with sales of commercial house and abide by sales contract of house signed with consumer. If the operator is found with one of the following conditions, consumer can demand the operator to cancel contract, to return payment paid for house, and to give compensation for loss arising from those conditions:
£¨1£©intentional concealment of truth not gaining permit for advance booking of commercial house to sign purchase and sales contract of commercial house;
£¨2£©intentional concealment of truth that the house on sale has been pledged or sold to sign purchase and sales contract of commercial house;
£¨3£©to pledge or sell house which has been covered in a signed contract;
£¨4£©to make commercial house which is not completed or not accepted as qualification available;
£¨5£©to breach appointment of contract to delay to make house available to the users, and not make house available to the users in reasonable period of three months after reminder;
£¨6£©poor quality of structure of principle part of house or other serious quality problem stop the house from being used normally;
£¨7£©error proportion of actual area of house exceeds 3%;
£¨8£©formalities for ownership certificate of house and certificate of land utilization are not gone through in period stipulated by the contract due to reasons of the operator;
¡¡¡¡If the operator is in one of the condition £¨1£©,£¨2£©,£¨3£©listed in the foregoing which makes the consumer is unable to get house, the consumer can demand the operator to undertake compensation liability with payment not more than twice as payment for house;
¡¡¡¡If breach of contract appointment or promise of the operator, including promise in house ads and publicity materials which has been a necessary part of the contract, or other behaviors of the operator, cause loss to the consumer, the operator should undertake civil liability according to law.
£²£® Operator of house decoration should sign written document with consumer to appoint construction period, construction expenses, construction quality, guarantee period, liability of breach of appointment, etc. If it is appointed that the decoration materials will be provided by the operator, the operator should use materials in line with state-stipulated safety index. If it is poor quality of construction or poor quality of decoration materials provided by the operator that cause damages to the consumer itself and property, the operator should undertake civil liability according to law.
£³£® Enterprise in business of administration of property and logistics should properly carry out management and service according to stipulations of laws, rules and appointment with the owner of the property. He whose management and service can not reach the standard appointed by the contract should undertake civil liability according to law.
